Problem: During some developments, land is set aside from development as part of the design process, a concession to the neighborhood, or for other reasons. This set aside is intended to be preserved as part of that application. Ownership of that piece and control of the use of it is different in all situations. At a later date, that set-aside often becomes the subject of a new development proposal. This creates friction with neighbors, a feeling of being duped by a previous land action that volunteered the land for non-development purposes.

Possible solution: Set asides need to be held as "commonly owned conservation areas" or held by the City of Eugene or a local land trust organization with an accompanying conservation easement.
